Arbitration And Waiver Of Right To Jury Trial And Waiver Of Right To Bring, Maintain, Or Participate In A Class Action

In consideration of you using the World’s Law website and any or all of its components  (including but not limited to its apps, legal forms, legal questions, and social media functions), you agree that such use is evidence of transactions in interstate commerce. Accordingly, you and World’s Law (“we”) agree that the Federal Arbitration Act (9 U.S.C. §§ 1–16 (2012), shall apply to, and govern the interpretation and enforcement of this provision of the Terms of Use known as the arbitration agreement.

We agree that any and all controversies, claims, or disputes with anyone (including World’s Law or any of its affiliates, subsidiaries, agents, employees, officers, directors, shareholders, assigns, successors, or predecessors in interest of World’s Law in their capacity as such or otherwise), shall be subject to arbitration.  BY AGREEING TO ARBITRATE ALL CONTROVERSIES, CLAIMS, OR DISPUTES, WE AGREE TO WAIVE ANY RIGHT TO A TRIAL BY JURY OR TO BRING, MAINTAIN, OR PARTICIPATE IN A CLASS ACTION.  The types of disputes and claims we agree to arbitrate shall be broadly interpreted to be as inclusive as the law allows.  However, you are not precluded from bringing your matter to the attention of federal, state, or local agencies.  If the law allows, such agencies may seek relief against World’s Law on your behalf.

We further agree that any arbitration shall be administered by the American Arbitration Association (“AAA”) and that one neutral arbitrator will be selected in a manner consistent with AAA’s national rules for the resolution of disputes. We agree that the arbitrator shall have the power to decide any motions brought by any party to the arbitration, including motions for summary judgment and/or adjudication, motions to dismiss and demurrers, prior to any arbitration hearing. We also agree that the arbitrator shall have the power to award any remedies available under applicable law, and that the arbitrator shall award attorneys’ fees and costs to the prevailing party except as prohibited by law.   We further understand and agree that the party initiating the arbitration claim shall pay for any administrative or hearing fees charged by the arbitrator or AAA. We also agree that the decision of the arbitrator shall be in writing and that any arbitration shall be conducted in the county of your legal residence.  The arbitration can conducted upon: (1) submission of written documents, (2) telephonic hearing, or (3) an in-person hearing pursuant to the AAA rules.  If you elect to hold the arbitration hearing in person or by telephone, World’s Law maintains its right to respond only by submitting documents, or by telephone.

Except as provided by the AAA rules and this agreement, arbitration shall be the sole, exclusive and final remedy for any dispute between you and World’s Law.   ACCORDINGLY, YOU WILL NOT BE PERMITTED TO PURSUE COURT ACTION REGARDING ANY CLAIM, OR BRING, MAINTAIN, AND PARTICIPATE IN A CLASS ACTION.

We agree that each may bring claims only in an individual capacity and not as plaintiffs, joint plaintiffs, or class members in any purported class or representative proceeding, or in the capacity of a private attorney general.  Furthermore, unless we agree in writing, the arbitrator shall not preside over any form of a representative class or proceeding.  We also agree that we shall not seek non-individualized relief that would affect other customers of World’s Law.

Nothing in this agreement or in this provision shall prevent World’s Law right to pursue provisional relief remedies available under the rules.  Nor shall anything in this agreement prevent or curtail World’s Law from seeking appropriate legal actions in a court of law to enforce the World’s Law Terms of Use, Disclaimer, User Conduct provisions or compliance of federal, state, or local laws by any user of World’s Law.
